ORDER:
The 11 Judges Constitution Bench of the Supreme Court of India in its judgement dated.31.10.2002 in W.P (Civil) No.317/1993 in TMA Pai Foundation and Others Vs State of Karnataka and Others, while dealing with the Private unaided educational institutions has held that,
“…….. A rational fees structure should be adopted by the management, which would not be entitled to charge a capitation fee. Appropriate machinary can be deviced by the State or University to ensure that no capitation fee is charged and that there is no profiteering, though a reasonable surplus for the furtherance of education is permissible …………” (Para 69 of the Judgement)
While answering Question No.5(c), the Supreme Court has held that,
“………. Fees to be charged by unaided institutions can not be regulated but no institution should charge capitation fee.”
2. The Government are conscious to the fact that the law declared by the Supreme Court binds everyone and the Government are bound to follow it. Before taking any firm decision with reference to the implementation of the law laid down by the Supreme Court mentioned in para 1 above, it was thought better to ascertain the views of the managements of the unaided professional colleges. Accordingly, the Government held a meeting with the managements of the unaided professional colleges in the State on 3.2.2003. About 200 managements of the colleges, both minority and non-minority have attended the meeting. Among other things, one of the views expressed by them relates to the prescription of fee to be charged by them from the students. Government also requested them to furnish their views in writing in the prescribed format on this point on or before 6.2.2003. Till 10.2.2003, 90 colleges have sent their views in writing. Out of the above,
(i) Majority of the managements have said that fees may be prescribed between Rs.35,000/- to Rs.40,000/-
(ii) Some managements have suggested prescription of fee as Rs.30,000/-.
(iii) Some managements have suggested a fee of Rs.49,000/-
(iv) Some managements have suggested a fee of Rs.42,000/-
(v) Some managements have suggested prescription of two categories of fees Rs.20,000/- to Rs.35,000/- as free seat and Rs.40,000/- to Rs.48,000/- as payment seat.
3. The Government examined the views expressed by the unaided professional institutions within the ambit of the law declared by the Apex Court and they have decided to issue necessary executive orders for the implementation of the law declared by the 11 Judges Constitution Bench of the Supreme Court of India in T.M.A.Pai Foundation case. They accordingly direct that, the Government need not fix the fee to be charged by the unaided professional institutions. However they advise the managements to consider fixing the fee as Rs.30,000/- per annum and further advise that meritorious students selected through the Single Window System be given some concession say Rs.5000/- in the rate of fee.
4. The Government direct that the orders issued in the G.O. first read above stand modified to the extent ordered in para 3 above in so far as it relates to unaided professional institutions including Polytechnic Colleges and Hotel Management and Catering Technology Institutions.
5. As per Section 3 of the Tamil Nadu Educational Institutions (Prohibition of Collection of Capitation Fee) Act, 1992, (Tamil Nadu Act 57 of 1992), Collection of Capitation fee is prohibited. The Government therefore direct that as per Section 7 and 8 of the Act, action will be pursued against the persons responsible for the violation of the provisions of the Act.

Four corporate houses of Coimbatore join hands to make the city’s parched patches water-rich and green.

It’s not just known as a textile or foundry city anymore. Coimbatore has another claim to fame now — it shows the way in harnessing corporate and people power for water resource reclamation and management of waste. Someone had to make a beginning for a different tomorrow. Four leading corporate houses in Coimbatore — Lakshmi Machine Works (LMW), Elgi, Bannariamman and Pricol — pooled their resources to introduce their expertise in rural watershed management to the city. Coimbatore blasts: Verdict on August 01

CPI(M) plans paadayatra. To protest against acquisition of land for airport expansion

The Communist Party of India (Marxist) is organising a padayatra from SITRA on Avanashi Road to Chinniyampalayam on July 14 to draw the attention of the Central and State Governments to the issue of land acquisition for airport.

In a release, D. Senthilraj, State committee member of the CPI(M), stated that the rumours regarding the proposed acquisition of lands for the airport expansion had resulted in residents going through mental agony.

These had benefited real estate agents in forcing people to sell lands and properties at throwaway prices.

Coimbatore airport is the biggest airport next to Chennai. As in the case of Chennai and Bangalore airports, why was the Airport Authority of India (AAI) not willing to have its airport constructed at a different place on a sprawling land, he wondered.

He also asked why the AAI and the district administration were not willing to acquire the vacant lands in the southern side of the airport.

Besides hundreds of houses, the proposed acquisition would result in demolition of a number of industries, mills, foundries and educational institutions. When there was so much land available along the airport and its southern side why did the acquisition plans focus only on residential colonies, he asked.

He also questioned how the local bodies gave no-objection certificate and approvals for houses that were in the proposed site for airport expansion.

To bring all these “facts” to light, the paadayatra would be taken out.

He also alleged that real estate barons having huge land holdings in the area were preventing the acquisition with political influence.

C. Govindasamy, MLA and P.K. Sathiyamoorthy, Palladam taluk secretary of CPI(M) would lead the paadayatra.

Aid for unemployed educated youth

The State Government provides Rs. 150 a month to those who have studied up to class X, Rs. 200 to those who have completed plus two and Rs. 300 to graduates. The applicant should be registered with the employment exchange for at least five years. They should not have engineering, medical or agriculture degree.

The age limit is 45 (as on September 30, 2007) for scheduled caste and scheduled tribe applicants and 40 for others. The monthly income of the family should not exceed Rs. 2,000.

Appriciation of Rupee against Dollar hurting spinning mills

Mill owners in the textile towns of Gobichettipalayam, Namakkal, Karur, Salem, Coimbatore, Dindigul and Tiruppur have shelved expansion plans.

The yarn prices have hit the rock-bottom owing to the rupee appreciation, while cotton prices have increased. Bank interest rates have gone up from 8 per cent to 12.5 per cent. The contracts, entered into in January, will keep the mills running till July.

Talking to The Hindu on Tuesday, Tamil Nadu Spinning Mills Association president A.P. Appu Kutti said: “In the present situation, we don’t see any future for the spinning mills. The future of 3.50 lakh employees is bleak.”

According to him, there are over 2,000 spinning mills in Tamil Nadu. On an average, they produce eight tonnes of yarn a day, roughly Rs. 1.80 crore worth of business.

Tiruppur Exporters Association president A. Sakthivel said:“By August, we expect 25-30 per cent of mills in Tiruppur to remain idle owing to lack of orders, and operations in ancillary units to come to a grinding halt.”

“Out of the 2.50 lakh workers at Tiruppur, 60-70 per cent are from other States. Now they will be asked to go back… Overall, the situation is turning from bad to worse.”

CII help to SHGs in Coimbatore

The Confederation of Indian Industry has started training women from Self-Help Groups (SHGs) in the district in basic business skills such as accounting and marketing.

According to its chairman, K. Thangaraj, about 500 women will be trained this year in association with Mahalir Thittam, which will identify the beneficiaries. Recently, a batch of 25 women completed training in computer operation at Sri Ramakrishna Engineering College. The duration of these courses depend on the syllabus. The computer training was held for a week.

The association has been conducting training for self-help group women in Computerised Numerically Controlled (CNC) machinery operation. This year, it plans to extend this activity to youth and also to more trades. They will be trained for entry-level jobs in manufacturing units. This course will also have placement facility for its beneficiaries.

Misleading advertisements by builders and real estate promoters

Avinashi Road continues to be in huge demand in Coimbatore. Apartment prices have touched Rs 3,500 per sq ft now - up 9% in two months. The Peelamedu area along Avinashi Road is also witnessing some demand now. Shreeram Properties have launched their project in Peelamedu at Rs 2100 per sq ft and villas are priced at Rs 2,600 per sq ft.

Sai Baba colony too has seen a significant increase over the last two months, with close to a 50% appreciation, and higher end projects now command Rs 4000 per sq ft.

According to estimates, approximately 3,000 apartments are under construction in Coimbatore. Major development is also underway on Trichy Road and Mettupalayam Road where many developers hold large land parcels.
